Loans to SMSF’s are often referred to as ‘limited recourse loans’, and there is a set of strict conditions applied to these loans. SOME GENERAL REQUIREMENTS

  • SMSF members are required to obtain legal and financial advice as part of the borrowing process.

  • To enable the SMSF to buy a property a special holding trust needs to be established.

RESIDENTIAL PROPERTY INVESTMENTS

  • The property must not be lived in by fund members or any related party.

  • You cannot rent the property to fund members or related parties.

COMMERCIAL PROPERTY INVESTMENTS

  • A commercial property can be rented to a fund member’s business.

  • One of the strict conditions is that the business must be paying a ‘market rate’ amount of rent.
